MOTION:WILBOURN June 24,1997 <br />Regular Meeting <br />SECOND:JENKINS Ord,No,97-67 <br />RE:REZONING #97-0037,BOARD OF COUNTY SUPERVISORS <br />(MELBOURNE RIGHT-OF-WAY)(GAINESVILLE MAGISTERIAL <br />DISTRICT) <br />ACTION:APPROVED <br />WHEREAS,this is an application to rezone 5.4 acres from R-10,Suburban <br />Residential;RT-8,Residential Townhouse;and 0(L),Office Low Rise to PMR,Planned Mixed <br />Residential,located approximately 0.5 mile north of the 1-66/Route 29 interchange;and <br />WHEREAS,this rezoning consists of acreage currently part of the dedicated <br />road right-of-way associated with the Melbourne subdivision;and <br />WHEREAS,the proposal will permit incorporation of the right-of-way into the <br />Heritage Hunt Planned Mixed Residential (Rezoning #97-0007)to permit a private road system, <br />in the Gainesville Magisterial District;and <br />WHEREAS,staff has reviewed the subject application and recommends <br />approval as stated in their staff report prepared May 6,1997;and <br />WHEREAS,the Planning Commission held a public hearing on this item on <br />May 21,1997,and recommends approval,as stated in Res.No.97-056;and <br />WHEREAS,a public hearing,duly advertised in a local newspaper for a period <br />of two weeks,was held on June 24,1997,and interested citizens were heard;and <br />WHEREAS,general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW,THEREFORE,BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Rezoning #97-0037,Board of County Supervisors <br />(Melbourne Right-of-Way); <br />BE IT FURTHER ORDAINED that the Board of County Supervisors’ <br />approval and adoption of any conditions or proffers does not relieve the applicant and/or <br />subsequent developers from compliance with the provisions of any applicable ordinances, <br />regulations,or adopted standards.
