MOTION:JENKINS June 17,1997 <br />Regular Meeting <br />SECOND:HILL Ord,No~97~59 <br />RE:ADOPTION OF AMENDMENT TO CHAPTER 13 OF THE PRINCE <br />WILLIAM COUNTY CODE:MOTOR VEHICLES AND TRAFFIC <br />ACTION:APPROVED <br />WHEREAS,VA Code Ann,§46.2~1242authorizes the Board of County <br />Supervisors,by ordinance,to provide that it shall be unlawful for a vehicle not displaying the <br />necessary license plates or placards to be parked in a parking space reserved for persons with <br />disabilities;and <br />WHEREAS,VA Code Ann,§46,2-1242 authorizes the Board of County <br />Supervisors,by ordinance,to assess and retain a fine of not less than $100 nor more than $500 <br />for its violation;and <br />WHEREAS,VA Code Ann,§~46.2-1247 through 46.2-1252 authorize the <br />Board of County Supervisors,by ordinance,to prohibit the counterfeiting of disabled parking <br />license plates and placards;the use of counterfeit disabled parking license plates and placards; <br />the alteration of disabled parking license plates and placards;the unauthorized use of disabled <br />parking license plates and placards;the fraudulent obtaining of disabled parking license plates <br />and placards;or the selling or exchange of disabled parking license plates and placards,any <br />violation of which is a Class 2 misdemeanor;and <br />WHEREAS,VA Code Ann,§46,2-1253 authorizes the Board of County <br />Supervisors,by ordinance,to prohibit a person from knowingly providing to another person a <br />valid,altered,or counterfeit disabled parking license plate or placard,a violation of which is a <br />Class 3 misdemeanor;and <br />WHEREAS,VA Code Ann,§~46.2-1242 and 46,2-1247 through 46.2-1253 <br />take effect July 1,1997;and <br />WHEREAS,amendments to Chapter 13 of the Prince William County Code <br />have been prepared to implement the powers enabled by VA Code Ann.§~46.2-1242 and 46.2- <br />1247 through 46.2-1253;and <br />WHEREAS,for the purpose of considering the attached amendment to the <br />County Code,a public hearing was duly advertised and held on the same;and <br />WHEREAS,the Board considers that the adoption of the proposed amendment <br />is in the public interest;
