MOTION: NOHE November 16, 2010 <br />Regular Meeting <br />SECOND: COVINGTON Ord. No. 10 -53 <br />RE: DENY - SPECIAL USE PERMIT #PLN2008- 00226, GRACE FILIPINO <br />CHURCH — COLES MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request for a special use permit to construct a new ± 5,435 <br />square foot (SF) addition to an existing ± 4,855 SF residential structure for use as a religious <br />institution, ultimately with 100 seats and 40 parking spaces. The house will be expanded and <br />converted with a new two -phase addition for church - related offices, meeting rooms, and a <br />sanctuary. The total area of the entire church structure at final build -out will be ± 10,290 SF, <br />with an overall building footprint of ± 5,455 SF. The site is located at 13112 Kahns Road, <br />approximately 670 feet south of the intersection with Champlain Drive and approximately <br />1,700 feet north of the intersection with Hoadly Road. The site is identified on County maps as <br />GPIN 7992 -18 -1429, is zoned A -1, Agricultural, and is designated Semi -Rural Residential and <br />Environmental Resource in the Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends denial, <br />as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on July 21, 2010, <br />recommended denial, as stated in Planning Commission Res. No. 10 -116; and <br />WHEREAS, a Board of County Supervisors public hearing, duly advertised in a <br />local newspaper for a period of two weeks, was held on November 16, 2010, and interested <br />citizens were heard; and <br />WHEREAS, as per LU- Policy 13, the proposed church development does not <br />adequately satisfy the requirement of protecting the neighborhood character from encroachment <br />of an intense /incompatible use. As per LU- Policy 14, the overall density, scale, and intensity <br />of the church use on such a narrow parcel, where the impacts cannot be adequately mitigated, <br />does not conform to the existing neighborhood. Despite the proposed conditions, the proposed <br />church use results in impacts that cannot be mitigated due to the constraints of the site and lot <br />configuration; and <br />WHEREAS, general welfare and good zoning practice are served by the denial <br />of the application; <br />NOW, THEREFORE, BE IT RESOLVED that the Prince William Board of <br />County Supervisors does hereby deny SUP 4PLN2008- 00226, Grace Filipino Church. <br />
