MOTION: STIRRUP October 26, 2010 <br />Regular Meeting <br />SECOND: COVINGTON Ord. No. 10 -49 <br />RE: SPECIAL USE PERMIT #PLN2011- 00001, WALNUT TREE FARM — <br />RENEWAL - GAINESVILLE MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request for renewal of a special use permit to allow a <br />garden center and landscaping service. The +/- 14.1 -acre site is located at 16800 Beverley Mill <br />Drive and approximately 1,225 feet east of its intersection with Turner Road at the end of the <br />cul -de -sac. The site is identified on County maps as GPIN 7198 -44 -9905. The site is <br />designated AE, Agricultural or Estate, in the Comprehensive Plan, is zoned A -1, Agricultural, <br />and is part of the Interstate 66 Gateway; and <br />WHEREAS, this proposal was previously approved as Special Use Permit <br />#PLN2008- 00366, Walnut Tree Farm, on February 17, 2009, which has since become null and <br />void, thus necessitating the need for renewal; and <br />WHEREAS, under a new case number SUP #PLN201 1 -0000 1, Walnut Tree <br />Farm — Renewal, will supersede SUP #PLN2008- 00366, Walnut Tree Farm; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval as conditioned, as stated in the staff report; and <br />WHEREAS, the Planning Commission, held a public hearing on October 6, <br />2010, and recommended approval, as stated in Planning Commission Res. No. 10 -148; and <br />WHEREAS, a Board of County Supervisors public hearing, duly advertised in a <br />local newspaper for a period of two weeks, was held on October 26, 2010, and interested <br />citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Special Use Permit #PLN201 1 -0000 1, Walnut Tree <br />Farm — Renewal, subject to the conditions dated September 23, 2010; <br />BE IT FURTHER ORDAINED that the Board of County Supervisor's <br />approval and adoption of any conditions does not relieve the applicant and /or subsequent <br />owners from compliance with the provisions of any applicable ordinances, regulations, or <br />adopted standards. <br />
