MOTION: NOHE September 14, 2010 <br />Regular Meeting <br />SECOND: COVINGTON Ord. No. 10 -42 <br />RE: ADOPTION OF AMENDMENT TO COUNTY CODE, CHAPTER 2, <br />(ADMINISTRATION) ARTICLE III, (DISCLOSURE OF PERSONAL <br />INTEREST BY COUNTY OFFICERS AND EMPLOYEES) TO CHANGE <br />THE ANNUAL DISCLOSURE REQUIREMENTS FOR MEMBERS OF <br />CERTAIN COMMUNITY DEVELOPMENT AUTHORITIES <br />ACTION: APPROVED <br />WHEREAS, the Board of County Supervisors of Prince William County (the <br />"Board "), pursuant to specific authority granted by the Code of Virginia, has enacted Chapter <br />2, (Administration), Article III (Disclosure of Personal Interest by County Officers and <br />Employees) for enhanced disclosure of personal interests by employees and members of <br />boards, committees and commissions; and <br />WHEREAS, under the current requirements of Sec. 2 -47.1 of the County Code, <br />as authorized by §2.2- 3115(A), VA Code Ann, members of boards of community development <br />authorities ( "CDAs ") are required to annually disclose their personal interests on the form <br />prescribed by §2.2 -3117, VA Code Ann.; and <br />WHEREAS, under Section 2.2- 3115(A), VA Code Ann., the Board has legal <br />authority to allow board members of CDAs to file the less comprehensive form prescribed by <br />§2.2 -3118, VA Code Ann.; and <br />WHEREAS, the Board has been requested to consider amending the County <br />Code to authorize the board members of CDAs that have fully executed the services proposed <br />to be undertaken by the CDA, with the exception of the payment of any outstanding debts of <br />the CDA ( "caretaker CDAs "), to annually file the less comprehensive form prescribed by §2.2- <br />3118, VA Code Ann.; and <br />WHEREAS, the Prince William Board of County Supervisors has conducted a <br />public hearing on September 14, 2010, which was advertised as required by law, to consider <br />adoption of the amendment to Article III, Sec. 2 -47.1 of the Prince William County Code, to <br />change the annual disclosure requirements for board members of "caretaker" CDAs; and <br />in 2010. <br />WHEREAS, this amendment shall be effective for annual disclosure filings due <br />
