MOTION: NOHE duly 27, 2010 <br />Regular Meeting <br />SECOND: CADDIGAN Ord. No. 10 -37 <br />RE: PROFFER AMENDMENT #PLN2010- 00199, BEAVER CREEK - COLES <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to amend the proffers associated with Rezoning <br />#PLN1995 -0010 in order to allow for a boundary adjustment and the relocation of the <br />designation of a 40 -foot wide undisturbed buffer, and the designation of the additional 25 -foot <br />selective clearing area along the Old Hickory Golf Course rough adjoining the Glass property <br />and rezone the created +/- 1.08 acres from PMR, Planned Mixed Residential to A -1, <br />Agricultural. The site is located on Asdee Lane, near its intersection with Coventry Glen Drive, <br />identified as GPIN 8193 -27 -8795 (pt) and is designated SRR, Semi -Rural Residential; in the <br />Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, held a public hearing on this item on <br />June 2, 2010 and recommends approval, as stated in Planning Commission Res. No. 10 -083; <br />and <br />WHEREAS, a Board of County Supervisors' public hearing, duly advertised in <br />a local newspaper for a period of two weeks, was held on July 27, 2010, and interested citizens <br />were heard; and <br />WHEREAS, general welfare and good zoning practices are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Board of County <br />Supervisors does hereby approve Proffer Amendment #PLN2010- 00199, Beaver Creek, subject <br />to proffers dated May 14, 2010; <br />BE IT FURTHER ORDAINED that the Board of County Supervisors' <br />approval and adoption of any proffers does not relieve the applicant and/or subsequent owners <br />from compliance with the provisions of any applicable ordinances, regulations, or adopted <br />standards. <br />1 <br />
