No. 10 -33 <br />RE: CONSIDER ADOPTION OF AN ORDINANCE TO DESIGNATE THE <br />CURVE ON BREEZY KNOLL DRIVE (STATE ROUTE- 3598) <br />BETWEEN WHISPERING WIND LANE AND CALM POND COURT IN <br />THE BLOOMS MILL COMMUNITY A NO PARKING AREA <br />PURSUANT TO THE AUTHORITY GRANTED BY SECTION 46.2 -1222 <br />OF THE CODE OF VIRGINIA - BRENTSVILLE MAGISTERIAL <br />DISTRICT <br />ACTION: APPROVED <br />WHEREAS, the parking of vehicles in this area causes safety concerns; and <br />WHEREAS, the Virginia Department of Transportation did not recommend no <br />parking signs, however, stated that they had no objection to Prince William County installing <br />no parking signs under a permit; and <br />WHEREAS, the Prince William County Department of Fire and Rescue has <br />recommended that at least one side of Breezy Knoll Drive be designated a no parking area to <br />facilitate the safe passage of emergency response vehicles; and <br />WHEREAS, a request was received by the Prince William County Department <br />of Transportation from the Blooms Mill Homeowners Association requesting the no parking <br />designation; and <br />WHEREAS, Section 46.2 -1222 of the Code of Virginia provides for the <br />installation of signs regulating parking on secondary highways by certain counties; and <br />WHEREAS, notwithstanding any other provision of law, the governing bodies <br />of Fairfax, James City, Loudoun, Montgomery, Prince George, Prince William, and York <br />Counties by ordinance may (i) restrict or prohibit parking on any part of the state secondary <br />system of highways within their respective boundaries, (ii) provide for the classification of <br />vehicles for the purpose of these restrictions and prohibitions, and (iii) provide that the <br />violation of the ordinance shall constitute a traffic infraction and prescribe penalties therefore; <br />and <br />WHEREAS, Breezy Knoll Drive is a secondary road; and <br />WHEREAS, in accordance with Section 13 -320.1 of the Prince William <br />County Code, the Board of County Supervisors must conduct a public hearing to obtain public <br />comments on restricting parking; <br />
