MOTION: COVINGTON May 4, 2010 <br />Regular Meeting <br />SECOND: NOHE Ord. No. 10 -19 <br />RE: DECLARE 9228 HORNBAKER ROAD, MANASSAS, VIRGINIA, A <br />NUISANCE IN ACCORDANCE WITH THE SPOT BLIGHT PROGRAM <br />GUIDELINES AND AUTHORIZE COUNTY STAFF OR <br />CONTRACTORS TO ENTER ONTO PROPERTY AND ABATE THE <br />NUISANCE THROUGH DEMOLITION AT THE OWNER'S EXPENSE - <br />BRENTSVILLE MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, the property at 9228 Hornbaker Road, Manassas, Virginia, is <br />dilapidated and detrimental to the safety, health, or welfare of the community and, <br />therefore, blighted because of the following conditions: it has been vacant or boarded for at <br />least one year; it has been the subject of documented complaints; it is no longer being <br />maintained for useful occupancy; and it lacks normal maintenance and upkeep; and <br />WHEREAS, § 36- 49.1:1, Virginia Code Ann., allows the Board of <br />County Supervisors to determine if a blighted property should be declared a nuisance; and <br />WHEREAS, on April 6, 2010, the Board of County Supervisors <br />authorized a public hearing to determine if the property is a nuisance; and <br />WHEREAS, the County Attorney's Office sent notice of the public <br />hearing, via certified mail, to the owner of the property; and <br />WHEREAS, a public hearing, duly advertised in a local newspaper for a <br />period of two weeks, was held on May 4, 2010, and interested citizens, including the <br />property owner, were given the opportunity to be heard; and <br />WHEREAS, the Board of County Supervisors has deemed the property <br />located at 9228 Hornbaker Road, Manassas, Virginia to be blighted as that term is defined <br />in Virginia Code Ann. § 36 -3 and a nuisance pursuant to Virginia Code Ann. § 36- 49.1:1; <br />and <br />WHEREAS, the Board of County Supervisors has agreed to grant the <br />owner sixty (60) days to demolish and remove the structure using the owner's resources; <br />and <br />WHEREAS, the Board of County Supervisors has determined that if the <br />owner has failed to complete the demolition and removal by July 3, 2010, then County <br />staff or its agents shall do so; and <br />
