Absent from Vote:None <br />Absent from Meeting:None <br />For information: <br />Acting Planning Director <br />January 7,1997 <br />Regular Meeting <br />Ond,No,97-6 <br />MOTION:WILBOURN <br />SECOND:CADDIGAN <br />RE:REZONING #97-0003,SHELTER CONSTRUCTION CORPORATION <br />(GAINESVILLE MAGISTERIAL DISTRICT) <br />ACTION:APPROVED WITH AMENDMENT TO PROFFERS AS <br />FOLLOWS: <br />Proffer #3 PARKS,RECREA TION AND OPEN SPA CE <br />Contributions designated for use in Gainesville District <br />Proffer #5 LIBRARY CONTRIBUTION <br />Contribution designatedfor use in Gainesville District. <br />WHEREAS,this is a request to rezone 30.2 acres from A-i,Agricultural to RR- <br />5,Rural Residential.The applicant is proposing to subdivide 3 existing 10-acre lots to allow a <br />total of 6 single-family dwellings on 5-acre lots,The site is located on the west side of Jackson <br />Hollow Road,approximately 0.1 mile northwest of its intersection with Waterfall Road,in the <br />Gainesville Magisterial District;and <br />WHEREAS,staff has reviewed the subject application and recommends <br />approval as stated in their staff report prepared November 20,1996;and <br />WHEREAS,the Planning Commission held a public hearing on this item on <br />December 4,1996,and recommended approval as stated in Res.No.96-156;and <br />WHEREAS,a public hearing,duly advertised in a local newspaper for a period <br />of two weeks,was held on January 7,1997,and interested citizens were heard;and <br />WHEREAS,general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW,THEREFORE,BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Rezoning #97-0003,Shelter Construction <br />Corporation,and accepts the proffers dated November 20,1996; <br />BE IT FURTHER ORDAINED that the Board of County Supervisors’ <br />approval and adoption of any proffers does not relieve the applicant and/or subsequent <br />developers from compliance with the provisions ofany applicable ordinances,regulations,or <br />adopted standards. <br />Votes: <br />Ayes:Barg,Caddigan,Hill,Jenkins,McQuigg,Seefeldt,Thompson,Wilbourn <br />Nays:None <br />Mr.Jay duVon,Esquire <br />Walsh,Colucci,Stackhouse,Emrich &Lubeley <br />13663 Office Place,Suite 201 <br />Woodbridge,Virginia 221 ~£~~~eBo~rd <br />CERTIFIED COPY_______________________
