MOTION: COVINGTON September 6, 2005 <br />Regular Meeting <br />SECOND: CADDIGAN Ord. No- 05-65 <br />RE: ZTA #PLN2005-00538, RECONSTITUTION OF THE HIGHER <br />EDUCATION OVERLAY DISTRICT AS A TECHNOLOGY OVERLAY <br />DISTRICT — COUNTYWIDE AND REZ #PLN2005-005389 ZONING MAP <br />AMENDMENT OF THE TECHNOLOGY OVERLAY DISTRICT AT <br />INNOVATION — BRENTSVILLE MAGISTERIAL DISTRICT <br />WHEREAS, on March 16, 2004, the Prince William Board of County <br />Super visors authorized Comprehensive Plan Amendment #PLN2004-00253, George Mason <br />University — Prince William Campus Sector Plan Amendment, to reevaluate the George Mason <br />University — Prince William Campus Sector Plan; and <br />WHEREAS, Part 506, Higher Education Overlay District (HEOD) of the <br />Zoning Ordinance is not consistent with the goals of the proposed revisions to the George <br />Mason University — Prince William Campus Sector Plan; and <br />WHEREAS, a new Technology Overlay District (TeOD) would be necessary to <br />implement the goals of the proposed George Mason University — Prince William Campus <br />Sector Plan Amendment; and <br />WHEREAS, on June 7, 2005, the Prince William Board of County Supervisors <br />initiated zoning text and map amendments to remove the HEOD and establish a TeOD for <br />Innovation; and <br />WHEREAS, Section 15.2-2286.A.7., Code of Virginia, allows amendments, <br />supplements or changes to regulations, district boundaries or classification of property <br />whenever the public necessity, convenience, general welfare or good zoning practice requires; <br />and <br />WHEREAS, the public necessity, convenience, general welfare, and good <br />zoning practice require the removal of the HEOD, creation of the TeOD, and designation of the <br />appropriate boundaries of the TcOD; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report-, and <br />WHEREAS, the Planning Commission held a public hearing on this item on <br />July 6, 2005, and August 31, 2005, and recommends appiuval, as stated in Planning <br />Commission Resolution Number 05-085; and <br />
