MOTION: COVINGTON June 28, 2005 <br />Regular Meeting <br />SECOND: NOHE Ord. No. 05-44 <br />RE: AUTHORIZE ABANDONMENT AND VACATION OF A DEDICATED <br />RIGHT-OF-WAY OF A PORTION OF EVELYN ROAD IN THE LAKE <br />JACKSON HILLS, BROWN AND HOOFF TRACT SUBDIVISION - <br />B NTSVILLE <br />BRENTSVILLE MAGISTERIAL DISTRICT <br />WHEREAS, right-of-way of Evelyn Road was dedicated in Deed Book 136 at <br />Page 7, with the Lake Jackson Hills, Brown and Hooff subdivision on February 24, 1949 and <br />the dedicated right-of-way was never developed as a street and remains as vacant land; and <br />WHEREAS, Bryan Jones is an adjacent property owner surrounding a portion <br />of dedicated right-of-way of Evelyn Road and a section of his house sits in the dedicated right- <br />of-way; and WHEREAS, Bryan Jones has requested that the County abandon and vacate the <br />right-of-way so his property complies with zoning regulations; and <br />WHEREAS, the County is considering abandoning and vacating the referenced <br />right-of-way since it will not be needed for a road; and <br />WHEREAS, according to VA Code Sections 33.1-166.1 and 15.2-2272, <br />abandoning the referenced right-of-way will discontinue the dedicated right-of-way for public <br />street purposes and the vacated right-of-way reverts to the adjacent property owners; and <br />WHEREAS, abandoning the referenced right-of-way will discontinue the <br />dedicated right-of-way for public purpose and the vacated right-of-way reverts to the adjacent <br />property owners; and <br />WHEREAS, Bryan Jones owns the property located at Lot 12, GPIN 7793-77- <br />5086; Lot 11, GPIN 7793-77-5785; former Lot 13, GPIN 7793-77-5270 and former Lot 14, <br />GPIN 7793-77-5874, and Franklin and Anne Tavenner own the property located at Lot 83A, <br />GRIN 7793-78-0312, of Block M, Section 2 of the Lake Jackson Hills, Brown and Hooff <br />subdivision; and <br />WHEREAS, the total area to be abandoned and vacated is approximately. 1464 <br />acres or 6,380 square feet and Bryan Jones will receive approximately 4,332 square feet of land <br />and Franklin and Ann Tavemner will receive approximately, 2,048 square feet of land; and <br />
