MOTION: STEWART September 5, 2006 <br />Regular Meeting <br />SECOND: BARG Ord. No. 06-77 <br />RE: ZONING TEXT AMENDMENT #PLN2006-00694, 2006 CORRECTIONS <br />AND ADDITIONS — ALL MAGISTERIAL DISTRICTS <br />ACTION: APPROVED <br />WHEREAS, in accordance with Title 15.2-2285 of the Code of Virginia, Ann., <br />the Board of County Supervisors may amend the Zoning Ordinance whenever it determines that <br />public necessity, health, safety, convenience, general welfare and good zoning practice <br />necessitate such change; and <br />WHEREAS, this is a request to amend sections of Article I, II, III, 1V, V, and IX <br />of the Zoning Ordinance to allow for shipping containers. amend required emergency access <br />width; permit motor vehicle fuel stations in industrial districts; incorporate exemptions from the <br />Chesapeake Bay Preservation Overlay District; incorporate reference to Va. Code relative to <br />petitioning for review of decisions of the Board of Zoning Appeals; permit carryout restaurants <br />as a by right use; and establish setbacks for retaining walls; and <br />WHEREAS, by way of Resolution No. 06-488, the Board of County <br />Supervisors initiated a zoning text amendment on May 2, 2006 to initiate amendments to the <br />Prince William County Zoning Ordinance; and <br />WHEREAS, by way of Resolution No. 06-120, the Board of County <br />Supervisors initiated a zoning text amendment on duly 19, 2006 to initiate amendments to the <br />Prince William County Zoning Ordinance; and <br />WHEREAS, amending the Zoning Ordinance relating to the above -referenced <br />items is required by the public necessity, convenience, general welfare and good zoning <br />practices, and is consistent with the intent of Title 15.2-2283 of the Code of Virginia, Ann.; and <br />WHEREAS, the Prince William County Board of the Supervisors duly ordered, <br />advertised, and held a public hearing on September 5, 2006, at which time public testimony was <br />received and the merits of the above referenced zoning text amendment were considered; and <br />WHEREAS, the Prince William Board of County Supervisors believes that <br />public general welfare as well as good planning practices are served by the zoning text <br />amendments; <br />
