MOTION: CADDIGAN June 6,2006 <br />Regular Meeting <br />SECOND: BARG Ord. No. 06-57 <br />RE: SPECIAL USE PERMIT #PLN2005-00621, BRIARWOOD <br />CONDOMINIUMS — DUMFRIESMAGISTERIALDISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to convert an existing 70 -unit apartment complex <br />to condominiums. The existing development has a net density of 28 dwelling units per acre. <br />Sec. 32-250.81 of the Zoning Ordinance requires an SUP or variance for the conversion of any <br />structure to condominium ownership when all the requirements of the Zoning Ordinance, <br />Subdivision Ordinance, Comprehensive Plan and DCSM cannot be met. The site is located at <br />the intersection of Briarwood Drive with Interstate Drive. The site is identified on County <br />maps as GPIN 8289-06-9616; approximately 3.84 acres of the ±3.9 acre site are zoned R-16, <br />Suburban Residential, and the remaining ±0.06 acres, at the entrance to the site, are zoned B-1, <br />General Business. The site is within the Dumfries Road HCOD, established after February 20, <br />1996, and the site is within Potomac Communities and is designated Suburban Residential High <br />and Environmental Resource; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on April 5, 2006, <br />recommended approval, as stated in Planning Commission Res. No. 06-063; and <br />WHEREAS, a Board of County Supervisors' public bearing, duly advertised in <br />v <br />a local newspaper for a period of two weeks, was held on June 6, 2006, and interested citizens <br />were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve SUP #PLN,2005-00621, Briarwood Condominiums, <br />subject to the conditions dated May 10, 2006; <br />BE IT FURTHER ORDAINED that the Prince William Board of County <br />Supervisors' approval and adoption of any conditions does not relieve the applicant and/or <br />subsequent owners from compliance with the provisions of any applicable ordinances, <br />regulations, or adopted standards. <br />
