MOTION: STIRRUP May 2, 2006 <br />Regular Meeting <br />SECOND: COVINGTON Ord. No. 06-50 <br />RE: ZONING TEXT AMENDMENT #PLN2006-00605, AGRICULTURAL <br />SETBACK ENCROACHMENTS - COUNTYWIDE <br />ACTION: APPROVED <br />WHEREAS, the Prince William Board of County Supervisors is authorized to <br />enact zoning ordinances to promote the general health, safety, and welfare with regard to factors <br />such as "facilitat[ing] the creation of convenient... and harmonious communities," under Section <br />15.2-2283 of the Virginia Code; and <br />WHEREAS, Prince William County Code, Section 32-301.06, provides that all <br />building and accessory structures in the A-1 zoning district must be set back a certain number of <br />feet from all rights-of-way; and <br />WHEREAS, there is not currently an exception from the setback requirements <br />for agriculturally -related accessory structures; and <br />WHEREAS, a zoning text amendment could provide for certain agriculturally - <br />related accessory structures in rural areas of the A-1 zoning district can encroach into the <br />required setback; and <br />WHEREAS, the general welfare and good zoning practice are served by <br />allowing certain agriculturally -related accessory structures in rural areas of the A-1 Zoning <br />District to encroach into the setback from fight-of-ways.- <br />NOW, <br />ght-of-ways;NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby adopt Zoning Text Amendment #PLN2006-00605, <br />Agricultural Setback Encroachments, by -right, as contained in Attachment C of the staff report. <br />ATTACHMENT: Attachment C — Article III, Agricultural and Residential Districts <br />Votes: <br />Ayes: Barg, Caddigan, Connaughton, Covington, Nohe, Stewart, Stirrup <br />Nays: None <br />Absent from Vote: None <br />Absent from Meeting: Jenkins <br />
