MOTION: STEWART April 4, 2006 <br />Regular Meeting <br />SECOND: CADDIGAN Ord. No. 06-38 <br />RE: REZONING #PLN2004-00375 TACKETT'S VILLAGE — OCCOQUAN <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to rezone ±17.36 acres from B-1, General <br />Business, and R-4, Suburban Residential, to PMR, Planned Mixed Residential, to permit a <br />maximum of 72 multi -family dwelling units; a minimum three-story, 50,000 square foot office <br />building, and a maximum 5,000 square foot freestanding retail/retail service building. The <br />application includes requests for waivers and modifications to allow a waiver of internal buffer <br />requirements, a modification of the perimeter buffer requirements, a waiver of the requirement <br />for more than one dwelling unit type, and a waiver of the maximum allowable percentage of <br />nonresidential uses in a PMR district. The site is located on the east side of Minnieville Road, <br />approximately 1,000 feet south of its intersection with Old Bridge Road. The site is identified <br />on County maps as GPINs 8393-21-3209, 8393-21-3300, 8393-20-3590, 8393-20-4582, 8393- <br />20-3169, 8393-20-5974, 8393-20-3560, 8393-20-4550, 8393-20-4742, 8393-20-5031, 8393-20- <br />1064, 8393-20-0955 and 8393-10-9970. The site is designated Regional Employment Center <br />(REC) and is part of the Parkway Employment Center Sector Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on March 1, 2006, <br />recommended approval, as stated in Planning Commission Res. No. 06-047; and <br />WHEREAS, a Prince William Board of County Supervisors' public hearing, <br />duly advertised in a local newspaper for a period of two weeks, was held on April 4, 2006, and <br />interested citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Rezoning #PLN2004-00375, Tackett's Village, <br />subject to the proffers dated April 4, 2006; <br />BE IT FURTHER ORDAINED that the Prince William Board of County <br />Supervisors' approval and adoption of any conditions does not relieve the applicant and/or <br />subsequent owners from compliance with the provisions of any applicable ordinances, <br />regulations, or adopted standards. <br />
