No. 06-15 <br />RE: APPROVE SPECIAL USE PERMIT #PLN2005-00592, POTOMAC <br />CENTER SECONDARY RESIDENTIAL UNITS — WOODBRIDGE <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request for a special use permit to allow approximately <br />232 multi -family units as a secondary use on approximately 7.48 acres at the northeastern <br />corner of the intersection of Dale Boulevard and I-95. The site is identified on County maps as <br />GPIN 8291-94-3373 (part). The site is zoned B-1, General Business, and is designated <br />Regional Commercial Center in the Comprehensive Plan; and <br />WHEREAS, staff leas reviewed the subject application and recommends denial, <br />as stated in the staff report; and <br />WHEREAS, the Planning Commission held public hearings on this item on <br />December 21, 2005 and January 18, 2006, and recommends approval, as stated in Planning <br />Commission Res. No. 06-007; and <br />WHEREAS, a Prince William Board of County Supervisors' public hearing, <br />duly advertised in a local newspaper for a period of two weeks, was held on February 7, 2006, <br />and interested citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William <br />Board of County Supervisors does hereby approve Special Use Permit #PLN2005-00592, <br />Potomac Center Secondary Residential Units, subject to the conditions dated February 1, 2006, <br />with the exception that Condition H10 shall read as follows: The Applicant agrees to remove <br />any graffiti from the property. Graffiti shall be deemed any inscription or marking on walls, <br />buildings or structures not permitted by the sign regulations in Sec. 32-250.20 et seq. of the <br />Zoning Ordinance. Any graffiti is to be reported to the Prince William County Police <br />Department before removal. Deed restrictions and covenants shall contain provisions that <br />require removal of graffiti from any structures or buildings. In the case of leased property, <br />lease agreements shall contain graffiti removal clauses that stipulate inunediate removal (within <br />72 hours) upon identification of graffiti from any building, trash dumpsters or other receptacles, <br />walls, fences, storage sheds, utility boxes, etc. Access to roofs shall be designed to prevent <br />scaling of walls by keeping dumpsters away from walls, and covering or enclosing drainpipes, <br />amongst other measures; <br />
