No. 06-13 <br />RE: APPROVE SPECIAL USE PERMIT #PLN2005-00590, POTOMAC <br />CENTER RETAIL ANCHOR C — WOODBRIDGE MAGISTERIAL <br />DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request for a special use permit to allow an approximately <br />220,000 square foot, freestanding retail use on approximately 10.24 acres at the northeastern <br />corner of the intersection of Dale Boulevard and I-95. The site is identified on County maps as <br />GPIN 8291-94-3373 (part). The site is zoned B-1, General Business, is partially within a <br />Highway Corridor Overlay District, and is designated Regional Commercial Center on the <br />Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends denial, <br />as stated in the staff report; and <br />WHEREAS, the Planning Commission held public hearings on this item on <br />December 21, 2005 and January 18, 2006, and recommends approval, as stated in Planning <br />Commission Res. No. 06-006; and <br />WHEREAS, a Prince William Board of County Supervisors' public hearing, <br />duly advertised in a local newspaper for a period of two weeks, was held on February 7, 2006, <br />and interested citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William <br />Board of County Supervisors does hereby approve Special Use Permit #PLN2005-00590, <br />Potomac Center Retail Anchor C, subject to conditions dated February 1, 2006, with the <br />exception that Condition #8e shall read as follows: The Applicant agrees to remove any graffiti <br />from the property. Graffiti shall be deemed any inscription or marking on walls, buildings or <br />structures not permitted by the sign regulations in Sec. 32-250.20 et seq. of the Zoning <br />Ordinance. Any graffiti is to be reported to the Prince William County Police Department <br />before removal. Deed restrictions and covenants shall contain provisions that require removal <br />of graffiti from any structures or buildings. In the case of leased property, lease agreements <br />shall contain graffiti removal clauses that stipulate immediate removal (within 72 hours) upon <br />identification of graffiti from any building, trash dumpsters or other receptacles, walls, fences, <br />storage sheds, utility boxes, etc. Access to roofs shall be designed to prevent scaling of walls <br />by keeping dumpsters away from walls, and covering or enclosing drainpipes, amongst other <br />measures; <br />
