No. 06.102 <br />RE: SPECIAL USE PERMIT #PLN2006-00005, FREEDOM TREE SERVICE <br />GAINESVILLE MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to allow a special use permit for a rural home <br />business, specifically a landscaping business and an increase in the size of the freestanding <br />signage. The applicant is also requesting to reduce the minimum site size to 4.4 aures, increase <br />the number of employees to seven (7), excluding family members, and to reduce the minimum <br />distance of the business activity from the front property line to 25 feet. The SUP site is located <br />on the west side of Gum Spring Road, approximately 113 mile north of Sudley Road (Route <br />234). The site is identified on County maps as GPIN 7599-43-5543. The site is designated <br />Agricultural or Estates (AE) and Environmental Resource (ER) in the Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission held a public hearing on this item on <br />November 1, 2006, and recommends approval, as stated in Planning Commission Res. 06-174; <br />and <br />WHEREAS, a Prince William Board of County Supervisors' public hearing, <br />duly advertised in a local newspaper for a period of two weeks, was held on December 5, 2006, <br />and interested citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Special Use Permit #PLN2006-00005, Freedom Tree <br />Service, subject to the conditions dated November 15, 2006; <br />BE IT FURTHER ORDAINED that the Prince William Board of County <br />Supervisors' approval and adoption of any conditions does not relieve the applicant and/or <br />subsequent owners from compliance with the provisions of any applicable ordinances, <br />regulations, or adopted standards. <br />
