MOTION: CADDIGAN January 17, 2006 <br />Regular Meeting <br />SECOND: BARG Ord. No. 06-08 <br />RE: REZONING #PLN2005-00119, EWELL'S MILL ESTATES — DUMFRIES <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to rezone ±88.15 acres from A-1, Agricultural, to <br />PMR, Planned Mixed Residential Low, for a maximum of 100 single-family detached <br />dwellings, and to rezone ±10 acres from A-1, Agricultural, to A-1, Agricultural with proffers. <br />In addition, the applicant has requested a waiver from the Zoning Ordinance standard that PMR <br />development, in excess of 50 acres, have secondary non-residential uses. The site is located on <br />the east side of Spriggs Road, approximately 800 feet north of its intersection with Gunston <br />Hall Road. The site is identified on County maps as GPINs 8091-60-6691, 8091-50-5679, <br />8091-60-1045, 8091-70-0555, and 8091-71-7904. The site is designated Suburban Residential <br />Low in the Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on November 16, <br />2005, recommended approval, as stated in Planning Commission Res. No. 05-143; and <br />WHEREAS, a Prince William Board of County Supervisors' public hearing, <br />duly advertised in a local newspaper for a period of two weeks, was held on January 17, 2006, <br />and interested citizens were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve Rezoning #PLN2005-00119, Ewell's Mill Estates, <br />subject to the proffers dated January 16, 2006; <br />BE IT FURTHER ORDAINED that the Prince William Board of County <br />Supervisors' approval and adoption of any conditions does not relieve the applicant and/or <br />subsequent owners from compliance with the provisions of any applicable ordinances, <br />regulations, or adopted standards. <br />
