MOTION: CANDLAND November 22, 2016 <br />Regular Meeting <br />SECOND: PRINCIPI Ord. No. 16-49 <br />RE: SPECIAL USE PERMIT #SUP2016-00003, BURGER KING — BALLS <br />FORD ROAD — GAINESVILLE MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a Special Use Permit (SUP) request to allow a restaurant <br />with a drive-through facility and associated signage modifications; and <br />WHEREAS, a new Burger King restaurant with secondary Philly Pretzel tenant <br />is being proposed; and <br />WHEREAS, the property is located at the northeast intersection of Balls Ford <br />Road and New Market Court, is currently addressed as 10820 Balls Ford Road, and is <br />identified on County maps as GPIN 47697-25-2644 (portion); and <br />WHEREAS, the SUP area encompasses ±1.12 acres on a pad site at the <br />southwestern portion of a ±5.19 acre property; and <br />WHEREAS, the site is zoned B-1, General Business, and is located within the <br />Data Center Opportunity Overlay District; and <br />WHEREAS, the site is designated REC, Regional Employment Center, in the <br />Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on <br />October 5, 2016, recommended approval, as stated in Planning Commission Resolution <br />No. 16-059; and <br />WHEREAS, a Board of County Supervisors' public hearing, duly advertised in <br />a local newspaper for a period of two weeks, was held on November 22, 2016, and interested <br />citizens were heard; and <br />WHEREAS, the Prince William Board of County Supervisors finds that public <br />necessity, convenience, general welfare, and good zoning practice are served by the approval of <br />the request; <br />
