MOTION: CANDLAND August 3, 2016 <br />Regular Meeting <br />SECOND: CADDIGAN Ord. No. 16-32 <br />RE: ZONING TEXT AMENDMENT #DPA2016-00016, LOTS WITH SPLIT <br />JURISDICTIONAL BOUNDARIES — COUNTYWIDE <br />WHEREAS, in accordance with Sections 15.2-2285 and 15.2-2286 of the Code <br />of Virginia, Ann., the Board of County Supervisors may amend the Zoning Ordinance <br />whenever it determines that public necessity, health, safety, convenience, general welfare and <br />good zoning practice necessitate such change; and <br />WHEREAS, there are lots that straddle Prince William County boundary with <br />another jurisdiction, where the portion within Prince William County does not meet the <br />minimum lot size for the zoning district in which the lot is located, but the entire lot does meet <br />the minimum required lot size; and <br />WHEREAS, an amendment to Section 32-601.40, Use of Nonconforming Lots, <br />is needed to include a provision for lots with split jurisdictional boundaries; and <br />WHEREAS, the Prince William Board of County Supervisors duly ordered, <br />advertised, and held a public hearing on July 13, 2016 at which time public testimony was <br />received and the merits of the above -referenced zoning text amendment were considered; and <br />WHEREAS, the Board finds that amending the Zoning Ordinance pertaining to <br />the above -referenced issue is required by public necessity, convenience, general welfare and <br />good zoning practice, and is consistent with the intent of Section 15.2-2283 of the Code of <br />Virginia, Ann.; and <br />WHEREAS, the Planning Commission held a public hearing on this <br />amendment, after which it adopted Planning Commission Resolution No. 16-047, unanimously <br />recommending approval; and <br />WHEREAS, County Staff recommends approval of the amendment; and <br />WHEREAS, the Prince William County Board of Supervisors finds that public <br />necessity, health, safety, convenience, general welfare and good zoning practices are served by <br />the adoption of this Zoning Text Amendment; <br />NOW, THEREFORE, BE IT RESOLVED that the Prince William Board of <br />County Supervisors does hereby adopt Zoning Text Amendment #DPA2016-00016, Lots with <br />Split Jurisdictional Boundaries. <br />
