MOTION: NOHE <br />SECOND: CADDIGAN <br />July 12, 2016 <br />Regular Meeting <br />Ord. No. 16-30 <br />RE: AMEND THE ZONING ORDINANCE TO REMOVE SECTION 32-250.71 <br />AND AMEND THE DESIGN AND CONSTRUCTION STANDARDS <br />MANUAL TO INCLUDE LANGUAGE THAT REQUIRES ALL <br />UTILITIES SERVING NEW USES TO BE PLACED UNDERGROUND <br />ACTION: APPROVED <br />WHEREAS, Section 32-250.71 of the County Zoning Ordinance requires all <br />on-site utilities; including water, sewer and power (transmission lines less than 34.5 KV), <br />natural gas and telephone serving new uses to be placed underground. The language has been in <br />the Zoning Ordinance since 1991 and does not apply to Ml or MT industrial districts or <br />residential subdivisions with lots greater than two acres in size; and <br />WHEREAS, there are rare instances when undergrounding the utilities is not in <br />the best interest of the County or the development customer; and <br />WHEREAS, in order for the County to meet the needs of its residents and to <br />promote the County as Open for Business, the County needs to have some flexibility built into <br />the underground utility requirement. This can be achieved by moving the underground utility <br />requirement from the Zoning Ordinance to the Design and Construction Standards Manual <br />(DCSM); and <br />WHEREAS, on February 16, 2016, the Board of County Supervisors initiated a <br />Zoning Text Amendment and DCSM Update through Resolution No. 16-237; and <br />WHEREAS, the Planning Commission duly ordered, advertised and held a <br />public hearing on June 1, 2016. Public testimony was received and the Planning Commission <br />considered the merits of the proposed amendments. The Planning Commission unanimously <br />approved the recommendation to shift the regulatory language from the Zoning Ordinance to <br />the DCSM; and <br />WHEREAS, after the underground utility requirement is moved, the Director of <br />Development Services will have the ability to waive or modify the underground requirement; <br />and <br />WHEREAS, the general welfare and good zoning practice will be served by <br />consideration of such an amendment; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby amend the Zoning Ordinance to remove Section 32-250.71; <br />
