MOTION:JENKINS December 16,1997 <br />Regular Meeting <br />SECOND:MCQUIGG Res.No.97-1028 <br />RE:AUTHORIZE CONDEMNATION AND EXERCISE QUICK TAKE <br />POWERS OF RIGHT-OF-WAY AND EASEMENT ACROSS PROPERTY <br />OWNED BY TERRY GALAMBOS AND BARBARA J.GALAMBOS <br />LOCATED AT 15809 CARDINAL DRIVE,NEABSCO MAGISTERIAL <br />DISTRICT,GPIN 8290-57-3827 IN CONNECTION WITH THE <br />CARDINAL DRIVE PROJECT <br />ACTION:APPROVED <br />WHEREAS,the design of Cardinal Drive improvements are such that Prince <br />William County requires approximately 6 square feet of land for street dedication and 239 <br />square feet of land for a temporary construction easement as depicted on the attached plat <br />entitled “Plat Showing Street Dedication on Lot 4,Garfield Estates Section Two,”dated June <br />17,1997 and prepared by Patton Harris Rust and Associates,across property owned by Terry <br />Galambos and Barbara J.Galambos,located in the Neabsco Magisterial District at 15809 <br />Cardinal Drive,GPIN 8290-57-3827;and <br />WHEREAS,the County has been unable to reach final settlement to acquire the <br />necessary right-of-way and easement and staff will continue to attempt to reach an agreement <br />with the Galambos for settlement;and <br />WHEREAS,right-of-way for the Cardinal Drive project is necessary to begin <br />construction of Cardinal Drive,and quick take condemnation of the Galambos’property is <br />necessary to maintain the project schedule by entering upon and taking said property;and <br />WHEREAS,the Board has conducted a public hearing under the provisions of <br />Sections 15.1-237 and 15.1-23 8E,VA Code Ann.,to determine if public necessity requires the <br />condemnation of the described property interest and to determine if necessity exists for the <br />immediate exercise of its quick take powers of condemnation to acquire the above referenced <br />right-of-way and easement; <br />NOW,THEREFORE,BE IT RESOLVED as follows: <br />1.The Prince William Board of County Supervisors does hereby find that the <br />public necessity exists for the condemnation of the involved property interest and for the <br />immediate exercise of its quick take powers to enter upon and take,prior to condemnation, <br />approximately 6 square feet of land for street dedication and 239 square feet of land for a <br />temporary construction easement as depicted on the attached plat,across property located at <br />15809 Cardinal Drive in the Neabsco Magisterial District,GPIN 8290-57-3827;and does <br />hereby determine that the appropriate compensation for the said right-of-way and easement and <br />damages,if any,is the appraised value of $496 available from index code 406009,sub-object <br />code 5826.
