ATTACHMENT <br />Ord.No.97-60 <br />June 24,1997 <br />Page 1 of 29 <br />PROPOSED AMENDMENTS TO THE PRINCE WILLIAM COUNTY CODE <br />CHAPTER 4.ANIMALS AND FOWL <br />ARTICLE 11,VICIOUS AND DANGEROUS DOGS <br />Sec.4-12.Definitions, <br />For the purposes of this article and unless otherwise required by the context,the following <br />words and terms shall have the meanings respectively ascribed to them by this section: <br />Dangerous dog.Any canine or canine crossbreed which: <br />(1)Has,without provocation,attacked,bitten or inflicted injury upon a person or <br />companion animal,other than a dog;or <br />(2)Has killed a companion animal. <br />No animal shall be found to be a dangerous dog if the threat,injury or damage was sustained <br />by a person who was (i)committing,at the time,a crime upon the premises occupied by the animal’s <br />owner or custodian,(ii)committing,at the time,a willful trespass or other tort upon the premises <br />occupied by the animal’s owner or other custodian or (iii)provoking,tormenting,or physically <br />abusing the animal,or can be shown to have repeatedly provoked,tormented,abused or assaulted the <br />animal at other times. <br />No animal which,at the time of the acts complained of,was responding to pain or injury,or <br />was protecting itself,its kennel,its offspring,its owner,or its owner’s property shall be found to be a <br />dangerous dog. <br />No police dog which is engaged in the performance of its duties as such at the time of the acts <br />complained of shall be found to be a dangerous dog. <br />Own;owner,The words “own”and “owner”shall include any person having a right of <br />property in a dog,an person who keeps or harbors a dog,any person who has a dog in his care,or <br />any person who acts as its custodian. <br />Serious bodily injury.Serious bodily injury includes multiple bites,serious disfigurement, <br />serious impairment of health,or serious impairment of a bodily function. <br />Vicious dog.Any dog which,on or after the effective date of this ordinance: <br />(1)Has killed a person;or <br />(2)Has inflicted serious injury to a person;or, <br />(3)Has continued to exhibit the behavior which resulted in a previous finding by a court <br />that it is a dangerous dog,provided that its owner has been given notice of that finding. <br />No animal shall be found to be a vicious dog if the threat,injury or damage was sustained by a <br />person who was (i)committing,at the time,a crime upon the premises occupied by the animal’s <br />owner or custodian,(ii)committing,at the time,a willful trespass or other tort upon the premises
