MOTION: STIRRUP May 4, 2010 <br />Regular Meeting <br />SECOND: CADDIGAN Ord. No. 10 -22 <br />RE: REZONING #PLN2009- 00523, THE MARQUE AT HERITAGE HUNT — <br />GAINESVILLE MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to rezone ±11.59 acres from PBD, Planned <br />Business District, to Planned Mixed Residential, to remove the age restriction for residents in <br />the existing building. The site is located on the north side of Heathcote Blvd., approximately <br />740 feet north of its intersection with Lee Hwy. The site is identified on County maps as GPIN <br />7497 -07 -6414, is within the Lee Highway (Route 29) Highway Corridor Overlay District, and <br />is designated Suburban Residential Low in the Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Planning Commission, at its public hearing on February 17, <br />2010, recommended denial, as stated in Planning Commission Res. No. 10 -032, as amended in <br />Res. No. 10 -032; and <br />WHEREAS, a Board of County Supervisors' public hearing, duly advertised in <br />a local newspaper for a period of two weeks, was held on May 4, 2010, and interested citizens <br />were heard; and <br />WHEREAS, general welfare and good zoning practice are served by the <br />approval of the application; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve REZ #PLN2009- 00523, The Marque at Heritage <br />Hunt, subject to the proffers dated March 17, 2010; <br />BE IT FURTHER ORDAINED that the Board of County Supervisors' <br />approval and adoption of any proffers does not relieve the applicant and /or subsequent owners <br />from compliance with the provisions of any applicable ordinances, regulations, or adopted <br />standards. <br />1 <br />
