MOTION: COVINGTON January 12, 2010 <br />Regular Meeting <br />SECOND: MAY Ord. No. 10 -02 <br />RE: ADOPT AN ORDINANCE TO DECLARE VARIOUS CUL -DE -SACS <br />WITH ISLANDS WITHIN THE BRAEMAR COMMUNITY TO BE NO <br />PARKING ZONES PURSUANT TO THE AUTHORITY GRANTED BY <br />SECTION 46.2 -1222 OF THE CODE OF VIRGINIA - BRENTSVILLE <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, the parking of vehicles in this area causes safety concerns; and <br />WHEREAS, a request was received by the Department of Transportation from <br />the Braemar Homeowners' Association; and <br />WHEREAS, the Braemar Homeowners' Association has discussed and voted <br />on requesting Prince William County to prohibit on- street parking in the referenced cul -de- <br />sacs; and <br />WHEREAS, Section § 46.2 -1222 of the Code of Virginia provides for the <br />installation and maintenance of signs regulating parking on secondary highways by certain <br />counties; and <br />WHEREAS, notwithstanding any other provision of law, the governing bodies <br />of Fairfax, James City, Loudoun, Montgomery, Prince George, Prince William, and York <br />Counties by ordinance may (i) restrict or prohibit parking on any part of the state secondary <br />system of highways within their respective boundaries, (ii) provide for the classification of <br />vehicles for the purpose of these restrictions and prohibitions, and (iii) provide that the <br />violation of the ordinance shall constitute a traffic infraction and prescribe penalties therefore; <br />and <br />WHEREAS, the referenced cul -de -sacs are secondary roads; and <br />WHEREAS, in accordance with Section 13 -320.1 of the County Code, the <br />Prince William Board of County Supervisors has conducted a public hearing to obtain public <br />comments on restricting on- street parking; and <br />1 <br />
