MOTION:CADDIGAN January 7,1997 <br />Regular Meeting <br />SECOND:HILL Ord~No~974 <br />RE:AUTHORIZE AMENDMENT OF CHAPTER 29,ARTICLE II OF THE <br />PRINCE WILLIAM COUNTY CODE:WEEDS AND GRASS <br />ACTION:APPROVED <br />WHEREAS,Section 29-17 of the Prince William County Code prohibits the <br />growth of weeds and grasses above a certain height;and <br />WHEREAS,Section 29-21 provides that violations of Section 29-17(b)are <br />punishable by a civil penalty,but implies that violations of Section 29-17(a)and (c)are <br />potentially punishable as misdemeanors;and <br />WHEREAS,the State enabling legislation for Section 29-17 provides only for <br />civil penalties,not criminal penalties;and <br />WHEREAS,Section 29-21 should be amended to provide for only civil <br />penalties in order to conform to the State enabling legislation;and <br />WHEREAS,Section 29-18 provides that citizens who wish to report violations <br />of Section 29-17 must send a signed complaint to the County Executive;and <br />WHEREAS,in order to encourage citizens to come forward with reports of <br />violations of Section 29-17,Section 29-18 should be amended to allow for anonymous <br />complaints;and <br />WHEREAS,notice ofpublic hearing regarding the proposed amendments was <br />duly scheduled and published on December 24th and December 31st in the Journal Messen~r <br />and Potomac News newspapers;and <br />WHEREAS,the Public Hearing was held this 7th day of January,1997; <br />NOW,THEREFORE,BE IT ORDAINED that the Prince William Board of <br />County Supervisors approves the attached amendment to Chapter 29 of the Prince William <br />County Code to regulate Weeds and Grass and growth thereof.
