MOTION: COVINGTON April 5, 2005 <br />Regular Meeting <br />SECOND: NONE Ord. No. 05-22 <br />RE: AMEND CHAPTER 26, TAXATION, OF THE CODE OF PRINCE <br />WILLIAM COUNTY TO APPROVE TAX EXEMPTION FOR <br />BIRMINGHAM GREEN ASSISTED LIVING, INC. FOR TAX <br />EXEMPTION <br />ACTION: APPROVED <br />WHEREAS, the Prince William Board of County Supervisors has approved a <br />policy favoring tax exemptions to worthy organizations; and <br />WHEREAS, prior to January 1, 2003, the Virginia General Assembly was <br />authorized to create classifications and grant designations for real or personal property tax <br />uxunlptlons, and <br />WHEREAS, the Constitution of Virginia was amended to transfer the <br />responsibility for granting real or personal property tax exemptions from the Virginia General <br />Assembly to the local jurisdictions; and <br />WHEREAS, effective January 1, 2003, entities seeking tax exemptions that do <br />not fall within the constitutionally -created tax exempt classifications must petition the Board <br />of County Supervisors for tax-exempt status; and <br />WHEREAS, in order for a nonprofit organization that uses property for <br />religious, charitable, patriotic, historical, benevolent, cultural or public park and playground <br />purposes to receive exemption from taxation for the property, the Board must adopt an <br />ordinance amendment exempting the property pursuant to Section 26-231 of Article XVI of <br />Chapter 26, Taxation, of the Code of Prince William County; and <br />WHEREAS, the Finance Department has received a request for property tax <br />exemption from Birmingham Green Assisted Living, Inc. for (1) a proposed facility that will <br />house a 77 -unit wing for the elderly from Northern Virginia and (2) the lease -hold interest in <br />the real estate on which the facility will be built; and <br />WHEREAS, a public hearing duly advertised in a local paper for a period of <br />two weeks, was conducted on April 5, 2005, and interested citizens were given an opportunity <br />to comment on the proposed ordinance; <br />
