No. 05-15 <br />RE: OPEN SPACE AGREEMENT (OSA)4PLN2005-00027, BULL RUN <br />COUNTRY CLUB (PERRYMONT LINKS, LLC) — GAINESVILLE <br />MAGISTERIAL DISTRICT <br />ACTION: APPROVED <br />WHEREAS, this is a request to terminate two open space contracts which <br />commit to retain 235 acres in open space through tax year 2010; and <br />WHEREAS, the site is locatcd at 3600 James Madison Highway, north of <br />Waterfall Road and west of Route 15, and is designated AE, Agricultural or Estate, and ER, <br />Environmental Resource, in the Comprehensive Plan; and <br />WHEREAS, staff has reviewed the subject application and recommends <br />approval, as stated in the staff report; and <br />WHEREAS, the Prince William County Planning Commission duly ordered, <br />advertised, and held a public hearing on October 20, 2004; December 15, 2004, and January 19, <br />2005; and <br />WHEREAS, general welfare and good zoning practices are served by the <br />approval of the application; and <br />WHEREAS, it is expressly determined that the applicant has demonstrated <br />good and reasonable cause to permit termination of the two open space contracts, which will <br />result in the administrative removal of all 235 acres from open space; and <br />WHEREAS, Section 58.1-3234, Va. Code Ann., provides that whenever <br />acreage in a land use preservation program changes, a new application is required. Therefore, <br />if the property owner desires to maintain the balance of the subject property in an open space <br />agreement for special taxation purposes, a new application must be submitted; <br />NOW, THEREFORE, BE IT ORDAINED that the Prince William Board of <br />County Supervisors does hereby approve aforesaid termination of the two open space contracts <br />for all 235 acres that are the subject of OSA PLN#2005-00027, Bull Run Country Club <br />(Perrymont Links, LLC); <br />BE IT FURTHER ORDAINED that the Board of County Supervisors' <br />approval and adoption does not relieve the applicant and/or subsequent owners from com- <br />pliance with the provisions of any applicable ordinances, regulations, or adopted standards. <br />
